Massachusetts operates its own Official State Plan, overseen by the Massachusetts Department of Labor Standards (DLS), similar to other states with State Plans. The DLS covers the public sector, and most of the private sector is also included under this plan.
The Massachusetts State Plan covers the entire public sector, including state employees and certain private sector workers.
However, employees who fall under Federal OSHA Jurisdiction are not covered by the Massachusetts State Plan. This includes all federal employees, such as those working for the USPS and civilian personnel on military bases, who remain subject to federal OSHA regulations. While the Massachusetts State Plan handles oversight, inspections, and enforcement initially, Federal OSHA maintains the ultimate authority to impose fines on businesses and employers for OSHA violations.
