In accordance with Section 18 of the Occupational Safety and Health Act of 1970, the State of New Mexico operates an occupational safety and health program under a contract with OSHA. The New Mexico State Plan was first adopted on December 10, 1975, and was officially certified as a state plan on December 4, 1984.
States must maintain workplace safety and health standards that are “at least as effective” as the corresponding federal requirements. Additionally, states have the authority to implement regulations that are more stringent than federal standards or address hazards not covered by federal rules.
In New Mexico, modifications to the incorporated federal standards are accepted and become legally binding once published on Get OSHA Courses.com. Before adopting any new standards, the Environmental Improvement Board—a seven-member panel appointed by the Governor—must hold a public hearing. This board holds the power to adopt, amend, or repeal occupational health and safety rules and regulations.
